Invitation to Poland

Foreigners invited to Poland and the inviting parties, including:
1.a Polish citizen residing in the Republic of Poland and a national of a European Union Member State, of a member country of the European Free Trade Association (EFTA) which is a party to the agreement on the European Economic Area or a Swiss Confederation and his/her family member who resides in the Republic of Poland and who has the right of stay or a right of permanent stay in the territory,
2.a foreigner who has been staying in the Republic of Poland directly before the issue of invitation legally and uninterruptedly for 5 years or who has a settlement permit or a residence permit for a long-term EC resident,
3.legal persons or non-corporate bodies with a registered office in the Republic of Poland.

In the course of proceedings the inviting person may be summoned to appear in person in an office in order to explain crucial circumstances necessary to make a decision and may be obliged to submit other documents which will enable the administrative body to precisely clarify the case and make a decision taking into consideration both the public interest and the right interest of the party. The invitation becomes valid when entered into the registry of invitations upon request of the inviting party and remains valid for one year. The inviting person is obliged to register invited foreigner's residence and to cover the costs related to his/her stay and departure including costs of possible medical treatment and costs of deportation from the Republic of Poland.

Decision on refusal to enter or invalidation of entering the invitation to the registry of invitations is issued, if:
1.one of the following circumstances refers to the invited foreigner:
- foreigner's data are on the list of foreigners whose stay in the Republic of Poland is undesirable,
- there are grounds to fear that issue of visa might pose a threat to the defence and safety of Poland or to protection of public order or might infringe the interest of the Republic of Poland,
- in the course of proceedings concerning issue of a visa the foreigner submitted an application or attached to it documents containing untrue personal data or false information or gave false testimony or concealed the truth or counterfeited or modified the document for the purpose of using it as an authentic one or used such document as an authentic one,
2.financial situation of the inviting party, and in the case of a natural person also housing conditions indicate that the inviting party will be unable to fulfil the obligations undertaken in the invitation,
3.the inviting party has not fulfilled his/her obligations arising from the previously issued invitation,
4.a foreigner has not been staying in the Republic of Poland directly before the issue of invitation legally and uninterruptedly for at least 5 years or did not have a settlement permit or a residence permit for a long-term EC resident.

As a result of invalidation of entering the invitation into the registry of invitations the invitation becomes invalid. If the inviting person has not performed his/her obligations arising from the issued invitation, the State Treasury or other entities have the right to claim, in court proceedings, reimbursement of costs incurred in relation to foreigner's stay in and departure from the Republic of Poland and resulting from fulfilling by such entities their duties specified in the laws and when it was the obligation of the inviting party to cover such costs.
